Yunus’s kangaroo court will not decide; the people of the country will ensure justice for the August 21 grenade attack. In the highly publicized August 21 grenade attack case, the High Court cleared all of the defendants, including former State Minister for Home Affairs Lutfozzaman Babar, who was given a death sentence, and Tarique Rahman, who was given a life sentence.

 

Yunus’s kangaroo court will not decide:  The result, which overturned the trial court’s decision, was announced by the High Court bench of Justices AKM Asaduzzaman and Syed Enayetur Rahman on Sunday, December 1. The case’s hearing was previously concluded on Thursday by the High Court bench consisting of Justices Syed Enayetur Rahman and AKM Asaduzzaman.

 

The hearing of the defendants’ petitions for acquittal and the case’s death reference was concluded on November 21. A little before 11:00 AM on Sunday, the verdict was read. The High Court declared the ruling, clearing all of the accused, at approximately 11:45 AM. In addition, the court ruled that the case was illegal.

The Bangladesh Awami League reacted to the ruling by writing on their verified page- Yunus’s kangaroo court will not decide; the people of the country will ensure justice for the August 21 grenade attack.

In reaction to the verdict, the public feels that such a shameful ruling show that this nation’s judiciary lacks independence and represents a culture of impunity. They believe that there is currently no justice or law in the nation. There are several murders, lootings, home invasions, and business occupations. The people as a whole opposes such a disgraceful decision.

Notably, on August 11, 12, and 15, 54 High Court benches were reconfigured by newly appointed Chief Justice Syed Refaat Ahmed, who also changed their jurisdictions. Twenty-four persons were killed in a grenade attack on Awami League President Sheikh Hasina’s rally on August 21, 2004. According to the Awami League, the attack had a political motive. The Sub-Inspector (SI) of the Motijheel Police Station at the time, Sharif Farooq Ahmed, submitted a complaint the next day. Before the Criminal Investigation Department (CID) took up the investigation, the case was handled by the Detective Branch (DB) and the local police.

On June 11, 2008, during the caretaker government phase, four years after the occurrence, Senior ASP Fazlul Kabir of the CID filed two distinct charge sheets: one under the Explosives Act and one for murder. Mufti Abdul Hannan, the head of the terrorist organization Harkat-ul-Jihad Bangladesh (HuJI-B), was one of the 22 people listed on the charge sheets.

 

The trial was started on October 29, 2008, when the suspects were charged by the Speedy Trial Tribunal. The prosecution requested additional inquiry after the Awami League took office in 2009, and the tribunal approved the request. Subsequent investigations were carried out by CID Special Superintendent Abdul Kahar Akand, who on July 3, 2011, filed a supplemental charge sheet that included 30 additional names on the list of suspects. The case contained the names of BNP Senior Vice Chairman Tarique Rahman, a number of ministers in the four-party alliance administration, and leaders of the BNP-Jamaat coalition. The judicial court proceeded with the trial of 49 accused after the execution of the death penalties of three men in another case, even though trials for a total of 52 accused were started in the two instances. The judicial court sentenced Tarique Rahman, Khaleda Zia’s political secretary Haris Chowdhury, and 19 others to life imprisonment. Additionally, 11 police and military officers were given various terms of imprisonment.

 

Following the verdict, on November 27 of the same year, the judgment, along with necessary documents, was submitted to the Death Reference Section of the High Court.
